Professional Indemnity and Public Liability cover for Migration Agents

Under thMigration (Migration Agents Code of Conduct) Regulations 2021, a registered migration agent must hold professional indemnity insurance or be a director, employee or member of an organisation that holds professional indemnity insurance The Migration Agents Regulations 1998 require that Professional indemnity insurance for at least $250,000 (source) be held by an individual or organisation of which the individual is a director, employee or member

What events does this policy cover? 

Here are some examples of situations that you may be covered for. 

 

Physical Injury:  

During a client consultation, the client trips and falls due to a cluttered pathway, and the client alleges that the migration agent’s office was not maintained properly. The client seeks compensation for the injuries sustained.  

 

Slips, Trips, and Falls:  

A visitor in a migration agent’s office has filed a claim that they slipped, tripped or fell in the office due to wet floors or misplaced equipment. They allege the premises was not safe for visitors.  

 

Professional Negligence:  

A client claims that advice or documentation provided by the migration agent did not meet expected professional standards, leading to the denial of their visa application, or other negative outcomes.  

 

Error of Judgment:  

A client believes that the migration agent’s recommendationssuch as the type of visa to apply for or the supporting documents neededwere inappropriate. The advice resulted in delays, financial loss, or complications in their migration process and the client is seeking financial compensation.
